GENERAL

The website www.ku-türe.com (“the website”) is owned and operated by Caroline Sarah Turner trading as Ku-türe (ABN 94 416 933 496) (“Ku-türe).

Please read these terms and conditions carefully before purchasing from this website as by using and purchasing from the website, you are entering into an agreement to be bound to the following terms & conditions.

Ku-türe reserves the right to change any content within this website including these terms and conditions from time to time.

Governing the operation of this web site are the laws of New South Wales, Australia.

PRODUCTS SOLD BY KU-TÜRE

All care is taken by Ku-türe to provide you with the promised unique garment or accessory.

Due to the nature of the business, Ku-türe cannot guarantee that your desired product will be available in your size, preferred colour or fabrication. Every care is taken to provide you with a wide size range.

In certain circumstances, designers who supply their items to Ku-türe warrant that their items are unique and that they will never repeat their items or make them available for sale other than by Ku-türe. To ensure that this service is kept to standard, please inform Ku-türe if you see your purchased item copied or sold anywhere by parties other than Ku-türe.

Each product sold by Ku-türe is chosen based on its design and merit. Seasons & trends are not followed as we take delight in bringing unique talented designers to you.

We also take care in bringing you consistently unique garments and products. However, some designers may use similar silhouettes or patterns and yet make them one-off/unique by using different fabric, texturing or detailing.

PURCHASE & PAYMENT

All prices quoted on the website are in Australian dollars. Deliveries to countries outside of Australia may be subject to the payment of additional taxes and customs duties. If this is applicable for any international orders, then the customer will be responsible for the payment of customs and import duties of the destination country. Because these duties vary by country, Ku-türe cannot determine what these fees will be. For more information, please contact your local customs office.

Payment for goods sold on the website can only be made through PayPal.

Cash, credit card, Cheques, B-Pay or money orders will not be accepted via the website.

Once payment has been received the goods will be despatched within 2 days of receipt of payment by Ku-türe.

PayPal Purchases

Ku-türe is linked with PayPal Australia Pty Limited ABN 93 111 195 389 for secure online payments. Please refer to http://www.paypal.com.au/au for full terms and conditions relating to payments made via PayPal. Ku-türe is not responsible, nor liable for the operations of third parties such as PayPal, and you should refer to the terms and conditions of PayPal before using or submitting any of your personal information.

When you opt to buy an item from Ku-türe.com you will be directly transferred to the PayPal website. Here you can pay for the goods using your credit card. You do not even need to set up a PayPal account. You can make payments in many currencies such as US Dollars, Pounds, Euro, Yen and Czech Kroun.

Once you have finished the payment process, you have the option of returning to the Ku-türe website to continue browsing.

RETURNS, EXCHANGES, CANCELLATION AND REFUNDS

RETURNS & EXCHANGES

Should you need to exchange or return your purchased item to Ku-türe, simply contact us at customerservice(at)ku-ture(dot)com, within 7 days of shipping date, stating the reason for exchange or return. We will then be in contact with you regarding the exchange or return.

Products will only be eligible for exchange or return if the products have not been worn have not been washed and must also include all original tags and your proof of purchase from Ku-türe.

Due to the nature of the business and products offered, exchanges for sizes cannot be accepted. Ku-türe takes great effort in providing an individual size chart for each garment. Please take care to check these, as a different size cannot be offered.

Exchange or returns will not be accepted on products that are not regular (such as discounted products) products, which are in the process of being manufactured or are ready for delivery. Furthermore, please choose carefully, as Ku-türe does not offer exchange, refund or return (unless the product is faulty or where otherwise required by law) on products such as earrings, swimwear, lingerie or other such products.

Should you wish to exchange a product and the product you wanted is not available, a credit note will be issued and is valid for 6 months from the date of issue.

CANCELLATION

Should you place an order, make payment and then cancel the order, a cancellation fee of AUS$15 will be charged. The remaining amount will be refunded via the original payment method.

REFUNDS

Refunds will only be given on faulty goods. This does not include a change of mind.

Please contact customerservice(at)ku-ture(dot)com, within 7 days of purchase, stating the reason for refund and return of the product will be organised.

Products must be returned in original packaging, unworn, unwashed and including all original tags and your proof of purchase from Ku-türe.

Should the product be deemed faulty by Ku-türe, the full amount will be refunded to you via the original method of payment or if you prefer, a credit note will be issued for the product.

Should the product not be deemed faulty by Ku-türe, the product will be returned to the customer and Ku-türe is not liable for any loss.

PRIVACY

Ku-türe may collect your personal details, such as your name and email address when you subscribe to the Ku-türe newsletter or when you contact Ku-türe through its online inquiry forms. Ku-türe will only send communications to you if you have requested to receive such communications (for example, the Ku-türe newsletter or details about upcoming Ku-türe promotions). If at anytime you do not wish to receive further communications from Ku-türe, then you may send an email to HYPERLINK "mailto:info@ku-t%A8%B9re.com" info(at)ku-ture(dot)com or click on the “un-subscribe” function on the communication sent by Ku-türe to opt out from receiving future communications. Ku-türe will ensure that your request is fulfilled within five days.

All care is taken to protect your privacy. Ku-türe will not disclose your email or any personal information to any third party without your consent. However, there are circumstances where Ku-türe will need to give a third party your personal information. Ku-türe will only use your personal information for the purposes of fulfilling your order, to receive communications as requested, or for other purposes which are permitted by the Privacy Act 1988 (Cth).

DISCLAIMER

All content is provided in good faith by Ku-türe. Although Ku-türe takes all care is taken in providing the correct details and prices, and ensuring that the information on this website is correct, the content on the website is provided on an "as is" basis, without warranties of any kind, and no warranty, express or implied, is given as to accuracy or completeness and Ku-türe does not accept any liability for any error or omission.

No warranties except those implied, and which cannot be excluded by law, are given by Ku-türe in respect of the products supplied. Where it is lawful to do so, the liability of Ku-türe for a breach of condition of warranty is limited to the repair or replacement of the products, the supply of equivalent products, the payment of the cost of repairing the products or acquiring equivalent products, as determined by Ku-türe.

In addition, Ku-türe accepts no responsibility for the content on any site to which a hypertext link from our website is provided. The links are provided "as is" with no warranty, express or implied, for the information provided within them. You must read the terms and conditions of the linked sites that you visit.

Ku-türe uses best efforts to ensure that there are no viruses on the website, but due to the nature of the Internet, Ku-türe cannot ensure such exclusion and no liability is accepted for viruses. When you use the website, Ku-türe recommends that you take all appropriate safeguards such as making sure your virus protection is updated and in effect.

NOTIFICATION OF CHANGES

Ku-türe reserves the right, at its sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such changes and/or modifications shall become effective immediately upon the posting on the website. Please review the website and policies periodically.
